1. Privacy Policy on personal data protection by the Agency is an integral part of the Terms of Service which is published at the following link.

2. The Agency respects your right to personal privacy and confidentiality of your personal data obtained as the result of use of this Website and takes all measures necessary for protection of their confidentiality and security, including by use of the general standards of technological and operational protection against possible loss, misuse, alteration or destruction. Taking into consideration special aspects and threats in the media, the Agency cannot guarantee absolute protection of your personal data, however, will make every effort to ensure protection of your personal data at the highest possible level.

3. In respect of all questions related to the processing, place of storage and use of personal data, please contact the Customer Care Service or send your requests at the following postal address of Tickets.ua: TICKETS.UA LLC, 2A, Pid Goloskom St., Lviv, 79020, Ukraine.

4. Processing of your personal data complies with the requirements of the Law of Ukraine “On Personal Data Protection”, other legislative acts of Ukraine, and terms set forth below. Please refer to the terms and conditions of the privacy policy (hereinafter referred to as the “Terms”) set forth below. Transfer of the personal data of the Agency is voluntary. If you disagree with the specified Terms, you shall not use the Website, and immediately leave it.

5. If you continue using this Website and proceed with logging into the Website or make a Booking, it is deemed that you:

• accept these Terms fully and unconditionally;
• are informed that this Website may collect your personal data and process them by means of technical capabilities of the Agency;
• give your consent to collection and processing of all personal data provided by you with the purpose specified in these Terms and the Terms of Service;
• give your consent to processing and cross-border transfer of your personal data if it is required by the terms of use of the Website and the Terms of Service;
• give your consent to the transfer of your personal data to the third parties (including the Service Providers/the Carriers) with the purpose of complying with the terms of the Agreement and provision of the Services;
• and consent to collection and storage of your personal data for an indefinite period, unless you request termination of processing of your personal data and/or their destruction, or unless the Agency requests termination of relations with you, or due to other reasons according to the legislative requirements.
  

In section My Account you can change your personal data at any time convenient for you. You may withdraw your consent to processing of your personal data by notifying the Customer Care Service via email.

In this case, the rules of termination of relations with the Agency will be effective pursuant to the Terms of Service, and all your personal data including information in section My Account will be deleted without the possibility of restorimg them. Despite withdrawing your consent to processing of personal data, some data may be still stored by the Agency if it is required by the legislation. In this case, your personal data will be deleted immediately once the requirements for statutory retention and processing of personal data cease to exist.

The Agency shall be entitled to process your personal data for marketing purposes related to provision of services through the website, in particular, to send you newsletters with information on current and planned services and promotions.

6. For the purposes of these Terms, the “Agency” shall include its affiliates or group affiliates, as well as representatives, officers, agents, employees, or partners, who can receive access to your personal data as a result of your using of this Website.

7. What type of data about you we collect and process: We receive and store any information you enter on the Website, provide to the Customer Care Service, or provide to the Agency by any other means to the extent required for provision of services or fulfilment of contractual obligations toward you. Personal data may be collected and processed automatically during your use of the website (e.g. through cookies).

Such information may include the following:

• information by which you can be identified (personal data), including your last name, first name, paternal name, date of birth, sex, citizenship, mobile phone number, postal and email address;
  
• data of ID documents (e.g., number and series of passport, its expiration date);
• payment card data (payment card number, expiration date, CVC/CVV-code, and cardholder name). We may store payment card data for further use, however, we do not store payment card CVC/CVV-code;
  
• automatically collected data;
• system files (IP-address, type of viewer, link / page exit and URL-addresses, number of clicks and interaction with the website, domain name, landing pages / content, viewed pages / content, device and location identifier);
• information from your profile (settings, information from search history, information from booking history, travel plans, etc.) and any other data collected automatically;
  
• any other information you leave on the Website voluntarily.
  

All data mentioned above may be collected through cookies (clause 10 of the Terms of Service). The Agency may also request additional information that may include your “sensitive” personal data (for example, information by means of which it is possible to identify your/recipient’s health condition or religious belief) to provide you/the Recipient with the highest possible level of service on the part of the Carrier / Service Provider /Agency. Such information may be related to your/recipient’s preferences in respect of the choice of seat in the vehicle or hotel room, meals, necessity of additional accompaniment or use of additional equipment when using the Services, etc. The Agency also offers possibility to register, log in or create personal account in Section “My Account” through your profile in social network (e.g. Facebook). In such case, your access credentials (name and email) will be imported from your personal account in the corresponding social network. Please note that when you use this option the Agency may receive certain information through the corresponding social network, such as: your name, age, location, preferences, occupation or any other information specified in your public profile in such social network.

The Agency may not request this information, it is automatically transmitted by the provider of the corresponding social network when using option “log in through social network”. Nevertheless, the Agency will only use the information which is required for creation of personal account in Section “My account”, and upon receipt of any other information deletes the unnecessary data. Upon creating personal account in Section “My Account” you will be able to add any information you want to share with the Agency and which is required for Order creation.

Also, we may request additional information that may include your “sensitive” personal data (for example, information by means of which it is possible to indicate your health condition or religious belief) to provide you with the highest possible level of service. Such information may be related to your preferences in respect of the choice of seat in the vehicle or hotel room, meals, necessity of additional accompaniment or use of additional equipment when using the Services. You shall understand that any general and “sensitive” personal data specified by you on the Website are provided by your conscious choice and only for provision of the Services selected by you. You shall also understand that provision of the Services shall be deemed impossible if some of the specified personal data have not been provided.

8. Data on third parties (Buyers/Passengers/Customers) that we collect and process. If you create a Booking of Services and make payment on behalf of or for the benefit of the third parties, the information you provide about them shall also be collected and processed by the Agency according to the same terms and conditions that apply to processing of your personal data. Providing such information about the third parties, you confirm that such third party is aware of these Terms, understands their consequences and gives his/her unconditional and full consent to collection and processing of their personal data in accordance with these Terms, and agrees that access to such information will be possible from My Account section only.  

9. Collection of data of underage persons. If you are an underage person, you shall not use this Website and are obliged to leave it immediately. This Website shall not be used and shall not be intended to collect information about underage Users or advertise information about Services to children without consent of their parents or legal representatives. The Agency shall process personal data of underage persons exceptionally in cases when such information is provided by their parents or legal representatives, and with the purpose of creating a Booking only. If the Agency becomes aware of the use of the Website by an underage person and provision of their personal data by them, or in cases of parents’ or legal representatives’ requests for deletion of personal data of the underage persons, such information will be deleted within the reasonable term, and the Agency will make every effort not to store and not to process personal data of the underage person. 

10. Automated data collection and cookies. The Agency may from time to time collect and receive additional data and information about you. For instance, when you use the Website there is automated collection of information on the device you use to visit the Website, software, operating system, IP address, the source of links and this Website, webpages viewed by you, preferences for a particular type of Service, links you have used to access the Website, etc. Such automated data collection takes place with the purpose of adjusting convenience of Website Services use and offers intended for you, as well as to prevent possible frauds.

If you use social networks to log into the Website, we may receive your data and preferences from such social networks according to the rules of information provision by these providers of services and privacy policy terms adjusted by you. By means of Google services, we may collect information to analyse your behaviour on the Website and preferences in selection of the Services. Collection and processing of your personal data by means of such services shall be carried out pursuant to these Terms and the Google privacy policy. Automated collection of some data and use of “cookies” and “web beacon” technologies improve the Website functionality and development of the most convenient use of the Website Services, as well as helps us assess the implementation of advertising and marketing campaigns, and offer information that may be interesting and useful to you. Cookies are small text files that can be stored on your computer (or any other device) during your first visit of the Website and allow us to recognize your computer during you repeat visit (for example, in order to remember your data for logging into My Account section). Cookies cannot in any way effect performance of your computer (or any other equioment) or its data, or infect your computer with a virus. We use short-term and permanent cookies on the Website which you may delete from your computer on your own. Please note that some data stored in the cookies, for example, passport information or any other data, are encrypted for security purposes. If you are not registered on the Website, cookies will not contain any confidential information. If you block cookies, some functions of the Website may be unavailable.

Web beacon are small graphic data typically used with cookies and may be included on the Website or in notifications which you receive from the Website. Use of web beacon files is similar to cookies. If you block the use of cookies, web beacon files will not be applied as well.

11. How we use your data and data of third parties.We use your personal data to provide Services and fulfil contractual obligations with Service Providers/Carriers regarding Services ordered by you; to communicate with you concerning the ordered Services and send you confirmation of your Bookings; to edit your Booking; to provide support in the use of the Website and the Website Services; to provide information on existing and future services and offers; to improve Website performance and User services; to provide answers to your requests and comments; to calculate bonuses if you participate in our loyalty programs; to encourage you to participate in our surveys and provide feedback; to find out the services which may be of interest to you; to satisfy your claims; to notify you of possible illegal or unlawful acts; to solve any issues which may arise under or in respect of fulfilment of the Terms of Service; for any other purposes of which we will notify you. Payment card data shall be used to confirm payment for the Bookings made by you on the Website.

The Agency strives to provide you with the highest possible level of service. Thus, we may notify you of your Booking status via email, and/or send you information with the list of offers on our Website which may be of interest to you and which may be related to the Services selected by you. If you do not wish to receive such emails, you may opt out of receiving them.

12. Google Analytics. The Agency uses Google Analytics that is a web analytics tool that helps us to understand how visitors interact with our Website. The following information is collected by Google Analytics: browser, type of gadget, model of gadget, location, country, city, service provider, screen resolution (on mobile), time on website, language, operating system, visited pages on the Website. All information generated by cookies about the use of the Website (including user's IP address) may be transmitted to and stored by Google on servers outside of Ukraine (e.g. in the USA). Google uses such information to examine the Website’s usage, prepare reports on the Website’s activities and to offer other optional services. Google may provide this information to the third parties if Google is legally required to, or if the third parties process the information on Google's behalf. Google Analytics cookies expire in 730 days (default value) and will be stored on your device within this period, unless you remove them manually.

13. Social media Plug-Ins. In case of your interaction with social media plug-ins implemented on the Website (e.g. the "Like" button provided by Facebook Ireland Ltd in Ireland, the "Twitter" button provided by Twitter Inc in the USA or the "Instagram" button by Instagram, LLC in the USA) or if you get access to the content on our Website that contains a plug-in, your device establishes direct connection with the servers of the respective social network operator. To our knowledge, the social network operators receive information via their plug-ins regarding your use of our Website, such as: your operating system, browser, IP address, the content currently being retrieved, the previous content retrieved and the date/time of content browsing.

This enables the social network operator to put together a profile on your user behaviour and add this information to your respective profile on the social network. It cannot be ruled out that such profile might be matched to you even if you are not registered with or logged-in to the social network. Please note that the Agency does not have any specific knowledge of the content of data transmitted to or used by the third-party social media plug-in providers. Please contact the specific social network operator directly to obtain this information and refer to their privacy policies for detailed information about collection, storage, processing or transfer of personal data, what rights you have and how you can achieve satisfactory privacy settings. In case you do not wish to transfer such data, the Agency recommends that you log out of the social network before using our Website.

14. Transfer of your data. Using this Website or creating a Booking, you agree that your data can be transferred to the third parties only for proper provision of the Services chosen by you which could not have been provided without such transfer of your personal data. When creating a Booking on the Website you give your consent to the transfer of your personal data to the third parties.
The Agency may share your information with the following entities:

• Operators, e.g. hotels, air carriers, etc. that render the Services ordered by you. All Services on this Website offered by the third parties are marked as such on our Website. We do not transfer your email address to operators, unless it is required for performance of the Services you booked with the Agency. The third parties may only use such data for these purposes. We do not impose any other limitations on operators with regard to use or disclosure of other types of your personal information. Therefore, we recommend you to read the data protection policy of each operator that provides the Services you booked on this Website on your own. Please note that such operators may contact you in order to obtain additional information about you, help you with the booking of Services, or answer your comments. In particular,  you hereby give us your consent to transfer your email address and mobile phone number to airline carriers for the purpose of the airline carriers to contact you in an operational disruption;

• Independent operators that offer services and act on our behalf, as well as operators that process payment card data, business analysts, customer service agents, marketing consultants, experts that distribute questionnaires or other offers and are in charge of prevention of payment frauds. We may as well allow independent operators to use data on our behalf if it is required for proper functioning of our Website or sending of online messages which may be of interest to you. Independent operators obtain access to and collect information which is required for their work. They are not allowed to share such data or use them for any other purposes. They must comply with the same data protection Terms as we do;
  

• Business partners with whom we jointly offer products and services, or their products and services offered on our Website. You always see whether the Services you requested belong to a certain independent company. In that case, only the business partner name will be indicated or accompanied by our name. If you accept their services, there is a possibility that we will transfer your information to such business partner – namely, your personal data. Please note that we do not supervise data protection policies of such business partners;
• We may also share your personal data with AIRHELP GERMANY GmbH for the purposes of provision of the AirHelp+ service if you order it. AIRHELP GERMANY GmbH may ask You to provide additional personal information about you. • Internet websites that provide links to our websites. If you accessed our Website from another website (e.g., through a link), we will share certain details about you with the websites that provide a link to us. We do not limit the use of your confidential information by such websites, and advise that you refer to the data protection policy of those websites from which you accessed our Website.
  

 We also may transfer your personal data to affiliates of the Agency or group affiliates, representatives, officers, agents, employees, or partners in order to implement the terms and provisions set forth in the Terms of Service. In addition, we may disclose your information:

• in reply to a writ of execution, summons letter or court decision; for protection from unlawful claims; or compliance with other legal requirements. In that case,  we reserve the right to lodge a judicial appeal;
• if we deem it appropriate to react to illegal acts or perform analysis of unlawful act in order to demand performance of such analysis or taking corresponding measures; to protect or reserve our rights, property, or security of the Agency, Website, or customers; in relation to our Terms of Service or other agreements;
• in relation to conclusion of agreements in certain spheres, in particular, liquidation, merger and takeover, pooling of capital or sales thereof, as well as, that is unlikely, bankruptcy. In other cases, not mentioned herein, you will be notified of your personal information disclosure to the third party. In that case, you may permit or prohibit us to transfer your personal information to the third party. In addition, we may transfer data collected for such third party, e.g., to an advertising agency or investor. For example, we may inform our advertising agencies about the number of people that visited our Website, the most popular flights, hotels and destinations. Such information shall not be deemed confidential and is used for further development of content and services which we hope will be of interest to you.
  

15. Cross-border transfer of data. You agree that in order to provide the Services, the  Agency may store and process your personal data (all or part of the data specified in Clause 7 of these Terms), including conduct security check of transactions on the servers and resources located outside of Ukraine. You shall give your unconditional consent to transfer of any or all your personal data outside of Ukraine only to obtain the proper level of the ordered Services.

Storage and processing of your personal data may be held on the servers and resources owned by the Agency or independent contractors, and may be located in any country of the world (including, but not limited to the countries of the European Union or European Economic Area, the USA, Canada).

If you use this Website being on the territory of the European Union, you hereby give your consent to the transfer of your personal data outside the European Union and European Economic Area. You are aware of and agree that your personal data may be transferred to the USA as well. Any cross-border transfer of data shall be held only to comply with the Terms of Service, these Terms, and with the purpose of providing you with the ordered Services. All cross-border transfer of data shall be limited to the categories of data and recipients that are required for compliance with the Rules, these terms and provision of the ordered services.

16. Amendments. The Agency, at its sole discretion, may from time to time make amendments to these Terms. The Agency will publish amendments on this Website. The Agency is not obliged to notify you of any amendments made to these Terms, only to publish them on this Website. The amendments shall be deemed effective as of the date of their publication. You shall regularly check for updates to this Terms on your own. You recognize and agree that your explicit acceptance of these Terms and/or use of this Website after the date of publication of amendments shall be deemed as your full and unconditional consent with the amended Terms. If you do not accept the modified Terms, you shall cease to use the Website.
